1. CoastActive is a brand that sells products online through www.coastactive.co.za (the “Website”) and through pop-up stores on the West Coast of Cape Town, based in the Western Cape province of South Africa.

2. CoastActive is owned by After the Rain Consulting (Proprietary) Limited (referred to as “ATR”, “we”, “us” and “our” in this document.

3. These Website Terms & Conditions contain all conditions relating to ordering, buying, selling delivery and return of any items on the Website.

4. These Terms & Conditions are applicable to any person who uses the Website, and who engages in any activities on the website. By clicking on the Accept Terms & Conditions block when concluding a deal or transacting in any way on the website, you are deemed to have read and understood these Terms & Conditions and agreed to be bound by these Terms & Conditions.

5. CoastActive focusses on people who are resident in West Coast of Cape Town in the Western Cape province of South Africa, however, we provide shipping and services to anyone within the borders of South Africa. CoastActive will NOT provide shipping services to anyone outside of South Africa, nor will we transact in any currency other than South African Rands (ZAR).

6. CoastActive allows third-party individuals to list items for sale on our Classifieds pages for a small fee. Items listed in the Classifieds are not directly sold by CoastActive or its agents, and CoastActive takes no responsibility for these items. Any items bought or sold through the Classified are directly the responsibility of the private individuals involved and CoastActive does not warrant, exchange or guarantee these items in any way.

Use of the Website

1. Only people over the age of 18 (eighteen) years may use the Website, as we require you to be of full legal capacity to enter in the agreement of purchase. If you under the legal age, you should involve a parent or legal guardian to assist you with your purchases and provide their legal consent on your behalf. Your parent or legal guardian will also be deemed to have accepted these Terms & Conditions on your behalf.

2. You agree that you will not use the information on this Website for any purpose other than that for which it was intended, and that you will not copy, distribute or share the information the Website without the prior written consent of ATR or one of its registered employees or

Stock Availability & Pricing

1. Due to the nature of this business, and the fact that many items are supplied by third-party suppliers on demand, CoastActive is unable to guarantee the availability of stock at any time.

2. Whilst CoastActive endeavours to ensure that any items that are no longer available are removed from the Website, and in the event that something you have ordered becomes unavailable, or is not available for immediate delivery, CoastActive will have no liability whatsoever other than to refund the money paid.

3. Pricing may change from time to time without notice due to fluctuations in the currency exchange rates, annual or seasonal increases, and you acknowledge that this is almost always out of the control of CoastActive. In the event that you purchase something which subsequently has a price increase from the supplier, CoastActive reserves the right to either charge the difference or refund the monies paid.

4. CoastActive will do its best to make sure that everything listed for sale on our site (other than items on the Classifieds section) accurately, clearly and correctly lists the description, photograph and price of the item. However, if there are any errors in any of the above-mentioned areas, CoastActive will not be liable in any way for any loss, claim or expense incurred by you, other than refunding you according to our Returns Policy if this is required.

5. CoastActive will, from time to time, offer certain products or items at a discounted rate for a limited time, and with limited quantities available. These products are often discounted due to having been discontinued or end-of-line products. In the event that you elect to purchase any of these discounted items, you acknowledge that they may not be returned for a refund.

Payments

1. CoastActive is committed to providing a secure online platform where you can transact with confidence and in complete safety.

2. Payments may be made by means of debit or credit card, or by making payment directly into our bank account in the form of an EFT. In the event that payment is not immediately credited to our account, CoastActive reserves the right to hold back on shipment until the funds are reflecting in our account, or we have received notification from the merchant services that payments have been processed.

Delivery & Collection

1. CoastActive allows you the option of either having your goods delivered via courier to your door or nearest locker, or alternatively, collecting these goods from one of our points of presence on the West Coast.

2. Delivery is calculated at time of checkout, and is an optional service provided at an additional cost to you. In the event that you decide to use the courier service to deliver, it is up to you to track your parcel and follow up on delivery times and locations directly with the courier service, and not with CoastActive.

3. Collections are available from our agent at the Yzerfontein Bowls Club, based in Yzerfontein, during certain hours and on certain days. The times that these collections are available are published on the Website, and CoastActive is not responsible should you come at a time when no one is available to assist with your collection if this is outside of these hours.

Returns

1. Our Returns Policy is listed separately to these Terms & Conditions and may change from time to time without notification. Your acceptance of these Terms & Conditions is also deemed to be acceptance of our Returns Policy.

2. CoastActive sometimes offers a group of two or more products bundled together into a single purchase deal. These bundles are often an extremely cost-effective way of purchasing multiple items for a related purpose, and as such, the product are not available for return separately.

1. CoastActive respects your right to privacy and follows all the rules pertaining to the POPI Act with regards to storing, retaining and deleting data in every possible way. For more information about how we do all of this, you may request a copy of our privacy policy at any time.

1. Using the Website is Your Responsibility. When you use this website, you do so at your own risk. You are responsible for any problems or losses that happen because of using the website or trusting the information on it.
